Terms and Conditions of Beyond Bathrooms

1. General

Any terms or conditions sought to be imposed by either party shall not be incorporated into the contract and shall have no effect unless agreed in writing by the other party.

2. Payment

2.1 Supply of Goods/materials

50% deposit of goods to be paid upon placement of order.  Remaining 50% to be paid prior to delivery/collection of goods.  For supply and installation a small proportion of material costs (as included within the labour and materials charge) may be required.

Labour charge

2.2 60% of labour charge to be paid directly to fitter 1 week after commencement date. Further 35% to be paid   after the second week and remaining 5% paid upon final inspection/sign off.

3. Delivery

3.1 We shall be entitled to make partial deliveries.   Signature of any delivery note by an agent, employee or representative of the buyer shall be conclusive proof of delivery. You must inspect the goods for damages or shortages and advise the company within 72 hours.

3.2 You agree to accept delivery within 1 month of the order date.  In the event of you not accepting goods within this 1 month period the company reserves the right to charge storage at the rate of 2% of the total order valve per month

3.3 Please ensure there is a convenient vehicular access point to your property, we are only able to deliver to a ground floor location

4. Price

Any price quoted is based upon current prices ruling as at the date appearing on your quotation, but the actual price charged to the Buyer under the contract shall be based upon such ruling price current as at the date of order. We reserve the right to correct any errors of pricing of goods/services if they were priced incorrectly.

5. Performance

5.1 We will install the items within a reasonable time as specified

5.2 If in our opinion it is not reasonably practicable for any reason to carry out any work we are instructed to carry out, we shall be entitled to refrain from carrying out or completing such work and will consult with you as to what work is to be undertaken.

5.3 If the cost to us of carrying out the work is subsequently increased by reason of increases in the cost material and/or labour and/or any other factor outside our control, then we shall notify you before undertaking any work to which increase will apply. If you require us to discontinue the work, you shall only be required to pay us for the work already carried out. 

6. Warranty

6.1 We warrant that as from the date of delivery for a period of 12 months the goods and all their component parts we have supplied, where applicable, are free from any defects in workmanship, construction or materials.  Any additional warranties described in the specification document are manufacturer’s warranty only.

6.2 We will warrant our workmanship for a period of 12 months from the date shown on completion certificate.  Any call back/call out after this period may be chargeable.

6.3 We warrant that the services performed under this agreement shall be performed using reasonable skill and care and of a quality conforming to generally accepted industry standards and practice.

6.4 We shall not be liable for any claim or claims relating to any breach of warranty expressed or implied, brought after 12 months of the date of delivery.

7. Cancellations and Returns

7.1 We permit you to cancel this agreement for supply and installation by sending written notice no later than 7 days after the date on which the agreement was set. A full deposit refund will apply.  If you request cancellation at a later date, then unless we are in breach of contract we have the right to refuse or retain all or part of your deposit as a contribution towards any losses or costs we suffer as a result of the cancellation.

7.2 If you wish to return goods that have been delivered or collected then we need to be notified with 7 working days and a re-stocking charge will apply as per the manufacturer’s policy. Goods must be un-opened and in their original packaging.

7.3 We reserve the right to cancel the agreement between us if:

7.3.1 We have insufficient stock to deliver the goods you have ordered;

7.4 Whilst every attempt is made to ensure that the quantity of tiles required is as accurate as possible allowing 15% for cuts and wastage, Beyond Bathrooms will only accept a return of two full boxes per order.

7.5 Special order tiles or non-stocked tiles have a non-returns policy

8. Liability

8.1 Except for death or personal injury caused by our negligent acts or omissions we shall only be liable for any loss or damage which is a reasonably foreseeable consequence of a breach of this agreement.

8.2 You will be responsible for all claim, liabilities, damages, costs and expenses suffered or incurred by us as a result of your breach or default in the discharge of your obligations.

8.3Where we need to carry out work on your premises and/or install equipment, we will not accept liability for the cost of repairing or replacing parts of your existing system/structure which occurs due to faults or wear and tear in your system/structure unless we have been negligent in not realising that such damage may occur or in the way we carried out the work.

8.4 In the event of us losing or damaging your goods we will pay for the reasonable costs of the repair or replacement (less wear or tear) of the item or provide you with a full refund if we have been negligent.

9. Statutory Rights

These terms and conditions do not affect your statutory rights

10. Data Protection

You consent to the computer storage and processing of your personal data by us in connection with this agreement.  We will ask for your consent for any before and after pictures being taken of your installation, which may be posted on our website in connection with this agreement.
